The Leave and License agreement of the tenant has an Annexure that shows Major Vs Minor works and explains what falls under each category. 

To find this: Please go to any Signed Agreement and go to Annexure 1. You will see Minor and Major works table. 


Usually Major works are taken care by the owner and minor by the tenant. But there are exceptions, such as:

1. Any damage as a result of age related wear & tear is charged to the property owner. 

2. Any major damage caused by tenant's negligence is charged to the tenant (eg. Seepage issues not reported on time and caused further damage to walls/woodwork)

3. Any minor issue is taken care by owner before the tenant move in and within 7 days of the tenant's move in. 

 

Clause 10 of the Leave & License agreement explains clause 10 in detail. This clause is pasted below for your convenience:


Clause 10:

The LICENSEE hereby undertakes that during the tenure of this Leave and License Agreement, the LICENSEE shall keep the Licensed Premises as well as all fixtures and fittings within the Licensed Premises in good and working condition and repair subject to normal wear and tear (due to age of fitting and fixtures). Any damage of fittings, fixtures or any part of the Licensed Premises, caused due to LICENSEE’s negligence will be borne by LICENSEE. Any minor repair work in the Licensed Premises shall be borne by the LICENSEE, even if not caused by the negligence of the LICENSEE. The LICENSOR shall bear the cost of minor issues only if they existed before the LICENSEE occupied the Licensed Premises and such defects are reported by the LICENSEE in writing by sending a mail to customer-support@propertyangel.in within 7 days of occupying the Licensed Premises. The LICENSEE shall also be liable to notify the LICENSOR of any major structural defects and damages immediately when observed, so the same can be rectified without causing any further damage to the Licensed Premises. The LICENSEE shall not be liable to bear the cost of any such major structural damages unless caused to due to negligence of the LICENSEE.
